Acceptance of Terms

Thanks for visiting Xoe Sweet (“Company,” “we,” “our,” “us”).
By enjoying our site and placing an order, you agree to these Terms & Conditions (“Terms”).
If you do not agree to these terms, please do not use our services.

All goodies are subject to availability — sometimes popular sweets sell out fast!
We may limit quantities, refuse orders, or discontinue products at any time.
Photos and descriptions are for reference; candies may vary slightly in color, shape, or packaging.
Prices are listed in U.S. dollars and may change without notice.

Xoe Sweet ships only within the United States.
Delivery times are estimates — we’ll do our best to get your candy to you quickly, but we can’t guarantee exact dates.
Risk of loss passes to you once the carrier delivers.
We do not currently ship internationally.

You must be at least 18 years old (or have parental/guardian consent) to shop with us.
By using our site, you confirm you meet these requirements.

We accept [credit cards, PayPal, etc.].
You agree to provide accurate billing information.
Fraudulent or unauthorized transactions may result in cancellation and reporting.

Because candy is perishable, returns are only accepted if your order is incorrect and unopened.
Claims must be made within 14 days of delivery with proof (photos, order number).
Refunds or replacements are issued at our discretion.

Our candies may contain or come into contact with common allergens (nuts, dairy, soy, gluten).
Please check product labels carefully.
Xoe Sweet is not liable for allergic reactions or misuse of products.

All logos, images, text, and designs belong to Xoe Sweet and are protected by copyright/trademark law.
Please don’t copy, distribute, or reuse our content without permission.

You agree not to misuse our site (e.g., hacking, fraudulent activity, spamming).
We may suspend or terminate accounts that break these rules.

These Terms are governed by the laws of California, without regard to its conflict of law principles.
Any disputes arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts located in Sacramento County, California.

Informal Resolution: Before filing any claim, you agree to contact us to attempt to resolve the dispute informally.
Arbitration: If we cannot resolve the dispute informally, it will be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
Location & Law: The arbitration will take place in Sacramento County, California, and will be governed by California law.
Class Action Waiver: You agree that disputes will be resolved only on an individual basis, and not as a class, consolidated, or representative action.
Exceptions: Either party may bring claims in small claims court in Sacramento County, California, or seek injunctive relief in court to protect intellectual property rights.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
The invalid, illegal, or unenforceable provision will be replaced with a valid and enforceable one that most closely reflects the original intent

To the maximum extent permitted by law, Xoe Sweet and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of our services or products.
Our total liability for any claim arising under these Terms will not exceed the amount you paid to us for the product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

Our products and services are provided on an “as-is” and “as-available” basis, without any warranties of any kind, whether express or implied.
We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that our services will be uninterrupted, secure, or error-free, or that our products will meet your expectations.
Any reliance on our products or services is at your own risk.
